Legal Basis for participants who complete "Purchase Challenges",

 associated with the promotion will earn one or more tickets to participate in

the"Spin the Wheel" game

"Purchase Challenge" is a specific task or activity related to purchasing selected products that, when completed, earns participants tickets to play the "Spin the Wheel" game. These challenges are highlighted within the BEES app under the "BUY, SPIN & GET A CHANCE TO WIN" section.

1. Spin the wheel: For every purchase with paid invoice, you will be able to spin the roulette. The roulette is an electronic draw game that randomly selects one of the following available options:

1. Smartphone

2. Powerbank

3. Free Nestle Products

4. Free 55 club B Points

5. Try Again

2.  NPI will upload digital material with promo mechanics in the BEES app. See mechanics below:

- Choose and purchase any of the available items from the participating SKUs provided.

- Once an item is ordered, it cannot be selected again

- The more frequent purchase within BEES application a user makes, the more Spins they will earn:

1. spin ticket for each 1st to 4th order

2. spin tickets for each order from the 5th order onwards.

3. The applicable challenges will be indicated in the BEES app in its respective section, featuring the image of the BUY, SPIN & GET A CHANCE TO WIN.

4. The promo period is from December 1 to 31, 2024

5. By joining and participating in the Promo, you agree and acknowledge the terms and conditions found on this link. (See the contents of the link below).

1. You have read the full mechanics of this Promo and agree to abide by the terms and conditions of the same;

2. You are 18 years old or above;

3. You voluntary consent to the sharing of your personal information, in compliance with the Data Privacy Act, for the purpose of claiming your prize, including your Name, Store Name/Number and Mobile Number.

4. You voluntary consent to the sharing of your name when chosen as the winner of the weekly raffle draw, for purposes of announcing the winners.

5. You will share personal information to claim your prize, including your: Name, Store Name/Number and Mobile Number.

6. You shall hold Nestle Philippines Inc. (NPI) free and harmless from any and all claims, suits and actions for damages or liabilities that may be brought by other persons, natural or juridical, in connection with your participation in the Promo, as well as the statements and declarations made by you in relation to the Promo;

7. NPI may, without further compensation to you: (a) reproduce, distribute, adapt, modify, make available and/or communicate to the public, exhibit, or broadcast any material or information regarding the Promo, through any means or media without restriction of any kind as to quantity, purpose or time, whether commercial or otherwise, or to any country or territory in the world; and (b) authorize any of the above activities;

8. NPI shall not be liable for any unauthorized use, reproduction and/or adaptations by third parties of any materials developed in the course of the Promo including but not limited to advertising materials;

9. NPI assumes no responsibility for:

   1. Any incorrect, inaccurate or incomplete information resulting from or caused by any of the equipment or programming associated with or utilized in the conduct of the Promo.

   2. Any error, omission, corruption, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, unauthorized access to or alteration of submissions of the Participants under the Promo or other similar instances that may occur in connection with or in relation to the Promo;

10. NPI, its parents, affiliates, subsidiaries and related companies or its officers, directors, employees, shareholders, representatives or agents shall not be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential, special or punitive damages arising out of any access to and use of the digital properties of NPI;

11. NPI shall have the right to disqualify any Participant who, upon NPI’s sole discretion, is not entitled to win if he or she does not comply with the mechanics of the Promo. The decision of NPI on this matter is final;-

12. NPI shall be entitled to cancel, discontinue or suspend the Promo on the basis of the occurrence of force majeure events or any events beyond their control that will not make it possible for them to continue with the conduct of the Promo without affecting the fairness and integrity of the same; and

13. The decision of NPI to cancel, discontinue or suspend the Promo on the basis of the foregoing is final and they will not engage in any dialogue with any person regarding such decision.
